Trace Terms of Service

Version 3 · Takes effect on December 5, 2026
Effective date: December 5, 2026
These Terms of Service ("Terms") are an agreement between you and MySupplements LLC, a New York limited liability company with its address at 108-14 72nd Ave, Forest Hills, NY 11375, USA ("MySupplements", "we", "us"). They govern your use of the Trace app, its website and its related services (together, "Trace").
By installing or using Trace, you agree to these Terms and confirm that you have read our Privacy Policy. If you don't agree, don't use Trace.
If you live in the United States, section 16 requires most disputes to be resolved by individual arbitration, not in court, and waives class actions. You can opt out within 30 days.

1. Who can use Trace

You must be at least 18 years old and able to enter into a binding contract where you live. Trace is for your own personal, non-commercial use. Don't use it for another person, such as a patient, a client or a child, unless that person has authorized you and the law allows it.

2. What Trace is, and what it is not

Trace is a personal journal and information tool. It helps you record what you eat, the supplements and medications you take, and how you feel, and it shows information about nutrients and known interactions.
Trace is not medical advice and is not a medical device. It does not diagnose, treat, cure, mitigate or prevent any disease or condition, and it is not a substitute for a doctor, pharmacist or other qualified professional.
•
Ask a professional first. Always ask a qualified healthcare professional before starting, stopping or changing a medication, supplement, diet or exercise program, and about anything you read in Trace. Never ignore professional advice, or delay seeking it, because of Trace.
•
Not for emergencies. If you think you may have a medical emergency, call your local emergency number right away.
•
Don't make medical decisions with Trace. Don't use Trace, or any number in it, to decide on a diagnosis or treatment. In particular, don't use it to dose a medication (for example, insulin by carbohydrates); to manage a condition that depends on exact intake, such as diabetes, kidney disease, phenylketonuria or an eating disorder; to decide whether a food is safe for an allergy or intolerance (Trace doesn't detect allergens); or to start, stop or change a medication or supplement.
•
Estimates, not measurements. Calories, protein, carbohydrates, fat, vitamins, minerals, caffeine, water, portions and cup sizes in Trace are estimates, many of them made by artificial intelligence (section 6).
•
Information may be incomplete or wrong. Nutrient values, food and label recognition, estimates made with artificial intelligence, upper-limit warnings, and notes about interactions and nutrient depletion may be incomplete, out of date or wrong. Product labels and databases change, and Trace may not know about every product, ingredient, interaction or condition that applies to you. A missing warning does not mean something is safe for you.
•
General targets. Daily targets and upper limits come from general dietary reference intakes for healthy people, adjusted for the details you give, or from the numbers you set. They are general guides, not a prescription for you.
•
No professional relationship. Trace is made by a pharmacist, and health professionals may review its content, but using Trace doesn't make any of them your pharmacist, doctor or other provider, and it creates no professional relationship between you and them or MySupplements.
•
You check what you log. You are responsible for checking the amounts and products you record against the actual label and your own instructions.
•
Your decisions are yours. You decide how to use Trace's information, and you use it at your own risk.

3. Your account

You can use much of Trace without an account, including food barcode and supplement catalog lookups on iPhone and Android. You agree to cloud AI analysis when you continue past setup's "Your data is yours" page, which says so under its Continue button; nothing is sent to AI before that. On iPhone and Android, AI features such as photo analysis also work without an account, within a daily allowance.
You agree to give accurate information, to keep your sign-in secure, and to tell us promptly about any unauthorized use. You are responsible for activity under your account, unless it results from our breach of these Terms.

4. Your content and your data

"Your content" means what you enter or upload, such as entries, photos, descriptions, notes and settings.
•
You keep ownership. You own your content. Most of it is stored only on your device; our Privacy Policy explains what leaves it and why.
•
Our license. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display your content only as needed to operate, provide, secure, support and improve Trace for you, and for any other use you separately agree to in the app. We use your content to train or improve AI models only if you turn that on in the app. This license ends when your content is deleted, except for copies we must keep by law or that remain for a limited time in backups.
•
De-identified data. We may create de-identified or aggregated information that does not identify you and cannot reasonably be linked back to you. We may use it for any lawful purpose, such as improving Trace, measuring how features perform and research. We won't try to re-identify it. Where the law treats such information as personal data, we use it only as the law allows.
•
Your responsibility. You confirm that you have the right to upload your content. Don't upload content that includes other people's personal information, such as faces or documents, unless you are allowed to.

5. Acceptable use

You agree not to:
•
break the law, or use Trace to harm anyone;
•
copy, modify, distribute, sell or lease any part of Trace, or reverse engineer or try to extract its source code, except as the law allows despite this restriction;
•
access Trace by automated means, scrape it, or overload, probe or disrupt its systems or security;
•
get around usage limits or access controls, or use another person's account;
•
upload malware, or content that is unlawful, infringing or abusive;
•
use Trace, its output or its data to build a competing product or to train an artificial intelligence model;
•
misrepresent Trace's output as professional medical advice or as our endorsement.

6. Artificial intelligence features

Some features use artificial intelligence (AI), including services run by our providers. AI reads meal photos, cup photos, your descriptions and corrections, labels and product names, and suggests what a food or drink is, its ingredients and preparation, portions and amounts, calories, protein, carbohydrates and fat, vitamins and minerals, what a cup holds, and product details.
AI makes mistakes. Its output is generated automatically and can be wrong, incomplete or inconsistent, even for the same input. For example, it can misidentify a food, miss an ingredient such as an oil, sauce or dressing or add one that isn't there, misjudge a portion, misread a label or product, or match a food to reference values that don't fit what you ate. Nutrient values come from reference data for typical foods, and the food you ate may differ in recipe, brand, preparation and size. AI results are estimates, not measurements, and we don't guarantee their accuracy.
Review AI results and correct them before you rely on them. Don't use them for medical decisions (section 2). We send content to an AI provider only as described in our Privacy Policy and, where the law or the app store requires it, only after you agree in the app.

7. Third-party services and data

Trace uses information from public and third-party databases, such as government nutrient and medication databases and product databases, and it works with services such as Apple and Google sign-in and the app stores. We don't control those services or their content, and we aren't responsible for them. Their own terms and privacy policies apply to your use of them.

8. Changes to Trace

Trace is evolving. We may add, change, limit, suspend or remove any feature, content or service at any time, including the AI models and providers we use, which can change results, and the free daily allowances and other usage limits. We may also stop offering Trace. Where a change materially reduces what you can do, we'll give reasonable notice when we can. Features marked as beta, preview or experimental are offered as they are and may change or end without notice.

9. Fees

Trace is free to use. Trace Plus is an optional subscription that adds features to it, such as reading every meal by photo or voice with no daily limit. The app shows what Plus includes before you buy.
We decide which features are free and which are part of Plus. We may change that, change what Plus includes, add other paid features, or stop offering Plus. A change won't take Plus away for a period you've already paid for: if we stop offering Plus, it stops renewing and stays on until the end of that period.
•
Buying. You buy Trace Plus in the app through the App Store or Google Play, which charges the account you use there. The price, billing period and renewal terms are shown before you buy. Purchases are also governed by the store's terms.
•
Free trial. If a free trial is offered, your subscription starts when the trial ends, and you're charged then, unless you cancel before it ends (on the App Store, at least 24 hours before).
•
Renewal. Trace Plus renews automatically at the end of each period, monthly or yearly, at the price then in effect, unless you cancel before the renewal date (on the App Store, at least 24 hours before). The store charges you for the next period around the renewal date.
•
Cancelling. You can cancel at any time in your App Store or Google Play subscriptions. Cancelling stops the next renewal, and Plus stays on until the end of the period you've paid for.
•
Refunds. The App Store and Google Play handle refunds under their own policies. We can't issue refunds ourselves.
•
Price changes. If the price of Trace Plus changes, the store tells you before the new price applies, and asks for your agreement where its rules require it.

10. Our intellectual property

Trace, including its software, design, text, graphics, data compilations and trademarks, belongs to MySupplements or its licensors and is protected by law. We give you a personal, revocable, non-exclusive, non-transferable license to install and use Trace on devices you own or control, under these Terms and the rules of the store you downloaded it from. We reserve all rights not expressly granted.

11. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

12. Disclaimers

To the fullest extent permitted by law, Trace is provided "as is" and "as available", without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We don't warrant that information in Trace is complete, accurate, current or suitable for you. In particular, we don't warrant the accuracy or completeness of AI results, food and label recognition, portions, nutrient values, targets, upper limits, or interaction and depletion information. You are solely responsible for your health decisions and for how you use Trace's information.
Some places don't allow these exclusions. Where that is the case, they apply only as far as the law allows, and the rights that your local law gives you as a consumer still apply (section 17).

13. Limitation of liability

To the fullest extent permitted by law:
•
No indirect losses. We won't be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, goodwill or health outcomes, arising from your use of Trace, your reliance on its information, or decisions you make based on it.
•
A cap on everything else. Our total liability for all claims relating to Trace is limited to the greater of (a) the amount you paid us for Trace in the 12 months before the claim and (b) USD 50.
These limits apply to every legal theory, even if we were told such damages were possible. They do not limit liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for anything else that cannot be limited under applicable law.

14. Indemnity

To the extent permitted by law, you will indemnify and hold harmless MySupplements and its members, employees and agents from claims, losses and costs (including reasonable legal fees) arising from your content, your misuse of Trace, or your breach of these Terms or of the law. This section doesn't apply to consumers in places where such an obligation is not permitted.

15. Ending these Terms

You can stop using Trace at any time and delete your data and account in the app (see Delete your account).
We may suspend or end your access, with or without notice, if you breach these Terms, if we must for legal or security reasons, or if we stop offering Trace. If we stop offering a feature you rely on, we'll try to let you export your data first.
Sections 4 (de-identified data), 5, 7 and 10 to 18 survive termination.

16. Disputes: arbitration and class-action waiver (United States)

This section applies if you live in the United States.
•
Talk to us first. Before starting a claim, email support@mysupplementsapp.com with your name, the issue and the relief you want. We'll try to resolve it informally within 60 days.
•
Binding individual arbitration. If we can't resolve it, you and we agree that any dispute about Trace or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its consumer rules, rather than in court. The arbitrator decides questions of arbitrability, except that a court decides the class-action waiver and mass-filing questions below. The Federal Arbitration Act governs this section.
•
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding. You and we waive any right to a jury trial.
•
Exceptions. Either party may bring an individual claim in small-claims court, or ask a court to stop infringement or misuse of intellectual property.
•
Many similar claims. If 25 or more similar demands are filed by or with the help of the same law firm or group, they will be administered in batches, as the arbitration provider's mass-arbitration procedures allow.
•
Opting out. You can opt out of this section by emailing support@mysupplementsapp.com within 30 days of first accepting these Terms, with your name and a statement that you opt out of arbitration.
•
If part of this fails. If the class-action waiver is found unenforceable for a claim, that claim goes to court and not to arbitration.
Governing law and courts. These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws rules. Any matter not subject to arbitration will be heard in the state or federal courts in Queens County, New York, and you and we consent to their jurisdiction.

17. If you live outside the United States

Section 16 does not apply to you. These Terms are governed by the laws of the State of New York, but you keep the protection of the mandatory laws of your country of residence, including consumer protection law, and you may bring proceedings in your local courts.
Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract. That includes the rights in the European Union, the United Kingdom, the Republic of Korea, Australia, Japan, Brazil and Canada. Where a provision of these Terms is not permitted by your local law, it applies only as far as that law allows.

18. General

•
Changes to these Terms. We may update these Terms. For material changes, we'll give you notice in the app or by email at least 30 days in advance, unless a change is required sooner by law or for security. Continuing to use Trace after a change takes effect means you accept it, where the law allows. If you don't agree, stop using Trace and delete your data.
•
Assignment. We may assign these Terms, for example in a merger, acquisition or sale of assets. You may not assign them without our consent.
•
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about Trace.
•
Severability and waiver. If any provision is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver.
•
Events beyond our control. We aren't responsible for delays or failures caused by events beyond our reasonable control.
•
Export laws. You may not use Trace where U.S. or other applicable export or sanctions laws prohibit it.
•
Language. If we provide these Terms in more than one language and they conflict, the English version controls, unless the law of your country requires otherwise.

•
MySupplements, not Apple, is responsible for addressing any claims about Trace or your use of it, including product liability claims, claims that Trace fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws;
•
MySupplements, not Apple, is responsible for investigating, defending, settling and discharging any third-party claim that Trace infringes intellectual property rights;
•
you confirm that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties;

•
you must follow applicable third-party terms when using Trace;
